These Terms & Conditions govern your access to and use of the Rentfly platform operated by RENTFLY PRIVATE LIMITED. Please read them carefully before using our services.

1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and RENTFLY PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at RENTFLY PRIVATE LIMITED, Pune, Maharashtra, India (the "Company", "Rentfly", "we", "us"). By accessing, browsing, registering on or using the Rentfly website, mobile application or any related service (collectively, the "Platform"), you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy, Community Guidelines and all other policies incorporated herein by reference. These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform. We may amend these Terms at any time; the revised version takes effect upon posting with an updated "Last Updated" date, and your continued use constitutes acceptance.

2. Eligibility Criteria

You may use the Platform only if you are (a) at least 18 years of age; (b) competent to contract under the Indian Contract Act, 1872; and (c) not barred from receiving services under any applicable law. If you use the Platform on behalf of a company, firm, brokerage or other legal entity, you represent that you are duly authorised to bind that entity to these Terms. We may refuse, suspend or withdraw access to any person at our sole discretion, including where eligibility cannot be verified or where prior violations have occurred.

3. Account Registration & Security

To access certain features you must register using a mobile number, email address or a supported third-party sign-in provider. You agree to provide accurate, current and complete information and to keep it updated. Certain features — including contacting owners, chatting and posting listings — require successful phone or email OTP verification. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account. Rentfly will never ask you for your password, OTP, CVV or banking PIN; never share these with anyone, including persons claiming to represent Rentfly. Notify us immediately at the support address below of any unauthorised access or suspected breach. Accounts are personal and non-transferable, and creating multiple accounts to evade limits or enforcement is prohibited.

4. Platform Role — Marketplace Disclaimer

Rentfly is a technology platform and neutral intermediary that enables owners, tenants, flatmates and brokers to discover and communicate with one another. We do not own, lease, sub-lease, operate, manage, inspect, broker, appraise or control any property listed on the Platform, and we are not a party to any rental agreement, licence, leave-and-licence deed, brokerage arrangement or payment made between users. Listing content — including rent, deposit, availability, area, floor, amenities, photographs, videos and ownership claims — is supplied by users; while we apply automated and manual moderation, we do not warrant its accuracy, completeness, legality or currency. Verification badges reflect the completion of specific checks only and are not a guarantee of a user's identity, title, solvency or conduct. Users are solely responsible for conducting their own due diligence, physically inspecting the property, verifying ownership and title documents, and executing legally valid agreements. Rentfly is an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 and claims safe-harbour protection under Section 79 thereof.

5. User Conduct & Prohibited Activities

You agree not to: post false, misleading, duplicate, expired, spam or bait listings, or list properties you have no right to list; misrepresent rent, deposit, location, ownership or availability; harass, threaten, defame, stalk or discriminate against any user on grounds of religion, caste, race, gender, marital status, sexuality, disability, food habits or place of origin; upload obscene, defamatory, infringing, unlawful or malicious content; solicit or transfer money outside a lawful rental transaction, or engage in advance-fee, deposit or impersonation fraud; harvest, scrape, crawl, index or bulk-download Platform data, or use bots, scripts or automated means without our prior written consent; reverse-engineer, decompile, probe, penetration-test, overload or interfere with the Platform, its servers or security features; circumvent verification, rate limits, paywalls or access controls; or use the Platform for any purpose that violates Indian law, including the Real Estate (Regulation and Development) Act, 2016 and applicable state tenancy and rent-control legislation. We may remove content, restrict features, withhold payouts, suspend accounts and report matters to law enforcement without prior notice.

6. Listings, Payments & Refunds

Posting a listing grants Rentfly a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, watermark, adapt and display that content for the purpose of operating, promoting and improving the Platform. You warrant that you own or have all rights necessary to grant this licence. Basic browsing and standard listings are free; premium subscriptions, featured placement and promotional products are chargeable at the prices displayed at the time of purchase, inclusive or exclusive of GST as indicated. Payments are processed by PCI-DSS compliant third-party gateways; we do not store full card details. Subscriptions may renew automatically where stated and can be cancelled from Profile → Payments → Subscription, taking effect at the end of the current billing cycle. Refunds are governed by our Refund & Cancellation Policy: premium subscriptions are refundable on a pro-rata basis within 7 days of purchase where no premium feature was used, and featured-listing fees are non-refundable once the listing is live. No refund is payable where an account is terminated for breach of these Terms. Refund requests must be sent to supportrentfly@gmail.com with the transaction ID and are ordinarily processed within 7–14 business days to the original payment method.

7. Intellectual Property Rights

All rights, title and interest in the Platform — including the Rentfly name, logo, trademarks, service marks, domain names, software, source code, databases, algorithms, ranking logic, design, layout, graphics, text and compilations — are owned by or licensed to RENTFLY PRIVATE LIMITED and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and applicable international laws. Rentfly® and the Rentfly logo are registered trademarks of RENTFLY PRIVATE LIMITED. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. No other right is granted. You may not copy, reproduce, republish, frame, mirror, distribute, sell, licence, create derivative works from or commercially exploit any part of the Platform without our prior written permission. Copyright complaints may be submitted under our Copyright Policy to rentflyofficial@gmail.com.

8. Limitation of Liability & Indemnity

The Platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant uninterrupted, secure or error-free operation. To the maximum extent permitted by law, Rentfly, its directors, officers, employees, affiliates and agents shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profits, revenue, data, goodwill, business opportunity or rental income, arising out of or relating to your use of the Platform, any listing, any dealing or dispute with another user, any payment or deposit made to another user, any fraud or misrepresentation by a user, or any third-party service (including maps, media hosting, authentication or payment providers). Our aggregate liability for all claims arising in any twelve-month period shall not exceed the total amount actually paid by you to Rentfly during that period, or INR 1,000, whichever is lower. You agree to indemnify and hold harmless Rentfly and its personnel from any claim, demand, loss, liability, penalty or expense (including reasonable legal fees) arising out of your content, your use of the Platform, your breach of these Terms or applicable law, or your dealings with any other user.

9. Suspension & Termination of Accounts

You may terminate your account at any time from Profile → Account, or by writing to supportrentfly@gmail.com. We may suspend, restrict or terminate your account and remove content, with or without notice, where we reasonably believe you have breached these Terms or the law, submitted fraudulent, misleading or infringing content, created risk or legal exposure for Rentfly or other users, or where required by a competent authority. Upon termination, your licence to use the Platform ends immediately and active listings are delisted. Provisions relating to intellectual property, limitation of liability, indemnity, governing law and dispute resolution survive termination. Data is retained or deleted in accordance with our Privacy Policy.

10. Governing Law, Jurisdiction & Dispute Resolution

These Terms and any dispute, claim or controversy arising out of or in connection with them, their subject matter or formation (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. The parties shall first attempt to resolve any dispute amicably through good-faith discussion by writing to the Grievance Officer. Any unresolved dispute shall be referred to arbitration by a sole arbitrator appointed by the Company under the Arbitration and Conciliation Act, 1996; the seat and venue of arbitration shall be Pune, Maharashtra, and the proceedings shall be conducted in English. Subject to the foregoing, the courts and tribunals at Pune, Maharashtra, India shall have exclusive jurisdiction over all matters arising out of these Terms.

11. Grievance Redressal & Contact Support

In accordance with the Information Technology Act, 2000 and the rules made thereunder, complaints regarding content, misuse or these Terms may be addressed to the Grievance Officer, RENTFLY PRIVATE LIMITED, RENTFLY PRIVATE LIMITED, Pune, Maharashtra, India, email supportrentfly@gmail.com. Complaints are acknowledged within 24 hours and ordinarily resolved within 15 days of receipt.
